PRIVACY POLICY

Protecting your privacy is important to each of roxnode.  This Policy explains how the members of the Roxnode collect, use and disclose the personal and non-personal information you may provide while using their respective websites (collectively, the "Websites") and the services they provide (collectively, the "Services").

  1. Your Consent

By using any of the Websites or the Services, or by submitting information to any member of the Roxnode , you signify your consent to the collection, use and disclosure of your personal information in accordance with this Policy and any applicable service agreement you have with any member of the Roxnode , including the Roxnode Terms of Use and Services Agreement and the Roxnode . Privacy Service Subscription Agreement (collectively, the "Services Agreements"), which are available by clicking here. If you do not consent to the collection, use, and disclosure of your personal information in accordance with this Policy and the Services Agreements, you may not use the Websites or the Services.

  4. Information Automatically Collected

Non-Personal Information: Each of the Websites automatically collects certain non-personal information regarding Website users, such as the date and time they access the Website, the Internet address of the website from which they linked directly to the Website, the browser or operating system they are using, and the Website pages read and content accessed or downloaded. This non-personal information is used for system administration purposes and to improve the Websites. Non-personal information may be disclosed to other persons and permanently retained for future use. If non-personal information is combined with personal information, then the non-personal information will be treated as personal information.

  7. Cookies: The Websites may use "cookies", a technology that adds a small amount of information on a Website user's computer to permit the Website to recognize future visits using that computer. Cookies are not executable cannot carry viruses and cannot install malware. Cookies enhance the convenience and use of the Websites. For example, the information provided through cookies is used to recognize you as a previous user of the Website (so you do not have to enter your personal information every time), offer personalized web page content and information for your use, and otherwise facilitate your Website experience. You may choose to decline cookies if your browser permits, but doing so may affect your ability to access or use certain features of the Websites.

For example, a cookie may be placed on your computer when you visit a Webnames.ca website, which is recognized and used by third party advertising networks to serve you with a Roxnode ad when you visit other websites within their advertising network. As described above, you may be able to set your browser to decline cookies. If you decline cookies you may still receive online advertising; however, it may be less personalized.   11. Personal Information You Specifically Provide

Your Personal Information: During your use of the Websites or the Services, you may be asked to voluntarily provide personal information (such as your personal name, email address, postal address, telephone number, fax number, and credit card details, login and password information). If you choose not to provide certain requested personal information, you will not be able to use certain features of the Websites or use certain Services.

Use of Your Personal Information: Each member of the Roxnode uses your personal information for the following purposes and as otherwise permitted by applicable law: (a) to contact and correspond with you regarding the Websites and the Services; (b) to bill you for the services requested by you and otherwise to administer your account; (c) to administer the Websites and the Services; and (d) as reasonably required by the rules, policies, procedures, and guidelines adopted and amended by domain name registration authorities from time to time. Each member of the Roxnode may develop a confidential profile for you, which will be used to provide services to you and facilitate your use of the Websites. Additionally, each member of the Roxnode may keep a record of all communications with you.

Emails and Newsletters: From time to time, members of the Roxnode may send to you email or other communications containing information about the Roxnode, the Services, the Websites, and other matters they believe may interest you. You may also sign up to receive newsletters from the Roxnode. At any time, you may ask the Roxnode to stop sending you email, newsletters and other information by sending your request to the Roxnode Privacy Officer at the email address noted below. From time to time, including as described in the Services Agreements, the members of the Roxnode may also send to you email containing important information regarding the Websites or the Services, which you may not opt out of receiving.

  18. Disclosure of Your Personal Information by Webnames.ca: Subject to the provisions of any applicable Services Agreement, each member of the Webnames Group may disclose your personal information in the following circumstances and as otherwise permitted by applicable law:

  20. (a)Authorized Disclosure: Each member of the Roxnode may disclose your personal information as permitted by an applicable Services Agreement.

(b)Disclosure to Authorizing Persons: If you use the Websites or the Services on behalf of another person or organization, such as your employer or a domain name registrant (an "Authorizing Person") or if you identify your organization (an "Organization") when you subscribe for an account, each member of the Roxnode may provide your personal information to your Authorizing Person or Organization. The Roxnode has no control over, and no responsibility or liability for, the use of your personal information by your Authorizing Person or Organization, and that use is not subject to this Policy. If you do not wish your personal information to be disclosed to an Authorizing Person or Organization, you should not reference that Authorizing Person or Organization in your account application form and you will not be permitted to use the Websites or the Services on behalf of that Authorizing Person or Organization.

(c)Disclosure to Affiliates, Agents, Suppliers and Service Providers: Each member of the Roxnode may provide your personal information to their affiliates, agents, suppliers and service providers for use in connection with matters relating to your use of the Websites and the Services or the provision of services to you. The Roxnode requires its affiliates, agents, suppliers and service providers to agree to use your personal information only for the purposes for which it is provided to them, and to protect the privacy of your personal information in a manner that is consistent with this Policy. If at any time you do not wish your personal information to be disclosed to certain affiliates, agents, suppliers, service providers, or any other persons, you may send your request to the Roxnode Privacy Officer at the email address noted below; however, this may affect your ability to use the Websites or the Services.

(d)Disclosure to Registration Authorities and Public Directories: Each member of the Roxnode may disclose your personal information as reasonably required by the rules, policies, procedures, and guidelines (including domain name dispute policies and rules) adopted and amended by domain name registration authorities (such as the Internet Corporation for Assigned Names and Numbers and the Canadian Internet Registration Authority) from time to time, including making certain of your personal information publicly available on searchable databases (including WHOIS databases) relating to domain name registrations. The information disclosed for those purposes (not all of which is personal information) includes the domain names sought to be or registered by you; the names, postal addresses, email addresses, voice telephone numbers and fax numbers of the technical and administrative contacts for the registered domain names; the full hostnames and internet protocol (IP) addresses of at least two nameserver hosts (one primary and at least one secondary) for each registered domain names; the corresponding names of those nameservers; the original creation date of the registration; and the date on which the registration expires. The Roxnode has no control over, and no responsibility or liability for, the use or disclosure of your personal information disclosed to comply with the rules, policies, procedures, and guidelines of domain name registration authorities, and that use and disclosure is not subject to this Policy.

  28. (e)Disclosure in Business Transfers: Each member of the Roxnode may be involved in the sale or transfer of some or all of their businesses. As part of a sale or transfer, each member of the Roxnode may disclose your personal information to the acquiring organization, but will require the acquiring organization to agree to protect the privacy of your personal information in a manner that is consistent with this Policy.

(f)Disclosure for Law Enforcement Purposes: Each member of the Roxnode may disclose your personal information if the disclosure is required by law (including to a government institution or agency that has asserted its lawful authority to obtain the information, or to comply with a subpoena or warrant or an order made by a court, person or body with jurisdiction to compel the production of information, or to comply with court rules regarding the production of records and information), to its legal counsel, or where they have reasonable grounds to believe the information could be useful in the investigation of unlawful activity. The Roxnode has no control over, or liability for, those persons' use and disclosure of your personal information, and that use and disclosure is not subject to this Policy.

  32. Depersonalized Information: Each member of the Roxnode may use personal information to create non-personal information regarding the use of the Website and the Services. Each member of the Roxnode may then disclose that non-personal information to other persons and permanently retain that non-personal information for future use.

Business Contact Information: To the extent permitted by law, the provisions of this Policy concerning "personal information" do not apply to information (such as your personal name, position or title, business address, business telephone number, business fax number and business email address) that enables you to be contacted at a place of business.

  34. Location of Information: The Roxnode will store and process your personal information in Vancouver, Canada. However, the disclosure of your information in accordance with this Policy and applicable law may result in your personal information being transferred outside of Canada, including to the United States. The laws of other countries regarding the collection, use, and disclosure of personal information may be different from the laws of Canada.

Securing Your Information: The Roxnode employs reasonable security safeguards appropriate to the sensitivity of the personal information in its possession or under its control in order to protect that information from unauthorized access, collection, use, disclosure, modification or similar risks. Nevertheless, security risks cannot be eliminated and the Roxnode cannot guarantee that your personal information will not be used or disclosed in ways not otherwise described in this Policy.

Accessing Your Personal Information: You may request access to your personal information and information about Roxnode collection, use and disclosure of that information by sending your request to the Roxnode Privacy Officer at one of the addresses noted below. Subject to certain exceptions and limitations prescribed by applicable law, you will be given reasonable access to your personal information, and will be entitled to challenge the accuracy and completeness of the information and to have it amended as appropriate. You can help the Roxnode maintain the accuracy of your information by notifying the Roxnode of any changes to your personal information.

    Other Matters

  37. Other Websites: The Websites may contain links to other websites or Internet resources. When you click on one of those links you are contacting another website. The Roxnode has no control over, and no responsibility or liability for, other websites or their collection, use and disclosure of your personal information.

  38. Former Users: If you cease using the Websites and the Services, or your permission to use the Websites and the Services is terminated, the Roxnode may continue to use and disclose your personal information in accordance with this Policy as amended from time to time.

Services Agreements: The Services Agreements contain important provisions, including provisions disclaiming, limiting, or excluding the liability of the Roxnode for your use of the Websites and the Services and provisions determining the applicable law and exclusive jurisdiction for the resolution of any disputes regarding your use of the Websites and the Services. Each of those provisions applies to any disputes that may arise in relation to this Policy and the collection, use and disclosure of your personal information, and are of the same force and effect as if they had been reproduced directly in this Policy.

Policy Changes: To accommodate changes in the Websites and the Services, changing technology, and legal developments, this Policy may be changed from time to time in the Roxnode discretion and without any prior notice or liability to you or any other person. The Roxnode collection, use and disclosure of your personal information will be governed by the version of this Policy in effect at that time. New versions of the Policy will be posted on the Website and are available upon request from the Roxnode Your continued dealings with the Roxnode or your use of the Websites or the Services subsequent to any changes to this Policy will signify your consent to the collection, use and disclosure of your personal information in accordance with the changed Policy. Accordingly, when you use the Websites or the Services you should check the date of this Policy and review any changes since the last version. You should also bookmark this page and periodically review this Policy to ensure that you are familiar with the most current version.

Roxnode Acceptable Use Policy

THIS POLICY GOVERNS THE USE OF THE ROXNODE.COM WEBSITES AND THE SERVICES PROVIDED BY ROXNODE.COM

Roxnode takes stringent efforts to ensure that all Domain Names registered through us comply with both our Terms and Conditions, as well as any Supplementary Agreements instituted by related Registries. Roxnode also has a zero tolerance spam policy as per our Roxnode Email Services Acceptable Use Policy. Our efforts are purposed to prevent the abuse of our domain registration infrastructure, web hosting, email services, and DNS services.

Procedure for receipt, handling, tracking of abuse reports:

Please note that due to the volume of complaints received, unless additional information is required from you, you will not receive a reply or update from us. We review all complaints within 24 hours of receipt for validity and will take appropriate action. As part of our investigation it may be necessary for us to corroborate your complaint with our customer. Please be assured that we take abuse very seriously and investigate each incident that is reported. We reserve the right to judge the appropriate response at our sole discretion or as required by Canadian law. Abuse reports are maintained on record for at least two (2) years and during such period, shall provide such records to ICANN upon request.

 

General Rules:

Use of the Websites and Services provided by Roxnode (referred to as "Roxnode ", "We", "Us", and "Our") must be lawful, ethical, and respectful of the legal rights and interests of all other persons. We may in Our discretion suspend or terminate access to or use of the Websites or Services that violate this Acceptable Use Policy.

 

Without limiting the generality of the foregoing, the following rules apply to the use of Our Websites and Services:

  1. Lawful Use: Use of the Websites and Services must comply with all applicable laws. The Websites and Services must not be used to post, upload, reproduce, distribute, publish, or otherwise transmit any information or materials that violate any applicable laws.

  2. Other Person's Rights: Use of the Websites and Services must not infringe the rights (including without limitation personal information privacy, personality and intellectual property rights) of any other person, or assist any person to infringe the rights of any other person. Without limiting the generality of the foregoing, use of the Websites and Services must not include any information or material that is or could be considered to be unlawful, harmful, threatening, abusive, harassing, tortuous, defamatory, vulgar, obscene, libelous, invasive of any other person’s privacy, promoting or providing instructional information about illegal activities, hateful, or racially, ethnically or otherwise objectionable.

  3. No Disruptive Use: The Websites and Services must not be used or permitted to be used, directly or indirectly, in any manner or for any purpose that damages, disables, harms, overburdens or impairs any portion of the Websites or Services or Our systems or any other person’s use and enjoyment of the Websites or Services or the Internet generally, or has the potential to do any of the foregoing, including without limitation an excessive amount of email or Internet traffic, an excessive distribution of data, or any other uses that may damage, disrupt, compromise or degrade the integrity, efficiency, performance or security of the Websites or Services or that may otherwise cause, facilitate, or result in the circumvention or breach of any user authentication, password, code, security or control measures regarding the Websites or Services or any other Internet resource or computer system.

No Spam: The Websites and Services must not be used to directly or indirectly post, upload, reproduce, distribute or otherwise transmit, or collect responses from or benefit from, any unauthorized or unsolicited email messages, unsolicited junk or bulk messages, unsolicited commercial messages, chain letters, or other forms of spam. We reserve the right to determine in its discretion whether a message constitutes spam.

  5. No Harmful Content. The Websites and Services must not be used to directly or indirectly distribute, transmit, communicate, or otherwise make available any materials that contain any intentional or unintentional virus, Trojan horse, worm, time bomb, cancelbot, spyware, malware, disabling device or other computer code that may damage, disrupt, disable, compromise, degrade, harm, detrimentally interfere with, surreptitiously intercept or expropriate, interrupt, lock, disable, erase, limit the functionality or use of, or otherwise adversely affect, or facilitate unauthorized access to or use of, the Websites, Services or any other computer system, hardware, software, telecommunications equipment, or data, or any materials that have had any copyright management information or controls altered or removed without the express permission of the owner of the materials.

  6. Prohibited Purposes. The Websites and Services must not be used, directly or indirectly, for any purpose or in any manner that is or may be abusive, contain nudity, deceptive, defamatory, derogatory, discriminatory, false, fraudulent, harassing, harmful, hateful, indecent, intimidating, invasive of the privacy rights of others, libelous, misleading, objectionable, obscene, offensive, pornographic, profane, racist, sexist, sexually explicit, slanderous, threatening, violent, vulgar, unlawful or otherwise objectionable (as determined by Us in Our discretion), or which advocate, depict, encourage, or tend to incite any such conduct, the commission of a crime or other unlawful activities.

  7. No Music or Video Distribution. The Services must not be used to directly or indirectly distribute, transmit, perform, communicate or otherwise make available any music or video content or other works or materials owned by other persons.

  8. Prohibited Products or Services. The Services must not be used to sell or promote, or facilitate transactions relating to, escort services; firearms; illegal drugs; information used to circumvent copy-protection devices; pharmaceutical or other controlled substances; sexual or adult paraphernalia; unauthorized copies of computer programs; weapons or instructions how to assemble, make or use weapons; or any products or services that are unlawful under any applicable laws.

  9. No Gaming. The Services must not be used to directly or indirectly offer or participate in gambling or other forms of gaming (including without limitation sweepstakes, raffles, lotteries, contests, or pyramid or Ponzi schemes).

  10. Proper Identity/No Misrepresentation: The Services must not be used to directly or indirectly distribute, transmit, perform, communicate or otherwise make available any email or other materials that contain modified, falsified, or forged address information, message headers, content, material, or other identifiers, or that impersonate other persons or otherwise disguise the origin of the email or materials, or falsely state or otherwise misrepresent an affiliation with another person.

  11. Use of Other Services: The services of another on-line service provider must not be used to engage in or facilitate any activity that violates this Acceptable Use Policy.

  12. Notices: Use of the Websites and Services must comply with all notices We may send to you or post on the Website regarding proper use of the Websites and Services.

Compliance, Consequences, and Law Enforcement Disclosure:

We may in Our discretion determine whether this Acceptable Use Policy has been violated, and may take such technological and other steps as We consider appropriate in Our discretion to stop the violation of this Acceptable Use Policy or other breach of the Agreement.

 

Violations of this Acceptable Use Policy constitute a breach of the Roxnode Terms of Use and Services Agreement governing the Websites and Services, and may result in termination or suspension of the Websites and Services and other consequences, and may subject the responsible persons to criminal and civil liability.

 

Our failure to enforce this Acceptable Use Policy, for whatever reason, will not be construed as a waiver of any preceding or subsequent violation of this Acceptable Use Policy. We will not be liable to You or any other person for failure to enforce this Acceptable Use Policy.

 

We may in Our discretion report perceived violations of this Acceptable Use Policy or applicable laws to law enforcement authorities. We will co-operate fully with law enforcement authorities in the investigation of suspected unlawful conduct, including disclosing individual's personal information (including email account information and payment information), and copies of email and other materials used in connection with the Websites and Services.

 

Nothing in this Acceptable Use Policy limits Our rights or remedies in any way with respect to a failure to comply with any of the foregoing provisions (including, without limitation, Our rights or remedies under the Webnames.ca Terms of Use and Services Agreement governing the Websites and Services) and We reserve all rights and remedies available to Us with respect to such activities.
